Terms and Conditions

General Terms and Conditions [TorFix24]

§ 1 Scope of the Contract
The following General Terms and Conditions govern the contractual relationship between the seller [Melike Demir-Cetin Ruthstr. 8 44149 Dortmund] and the respective buyer on the online sales platform.
§ 2 Subject Matter of the Contract
The subject matter of the respective contract is the sale of goods by the seller to the buyer on the sales platform.
These goods are offered by the seller either through their shop.
The goods listed on the seller's general website are binding offers by the seller to conclude a purchase agreement for the respective item.
§ 3 Conclusion of the Contract, Contract Language
The buyer can purchase goods offered through the seller's shop immediately. Goods offered in the shop in the Buy It Now format and auctions for these goods are also visible on the general eBay websites. This does not apply to the seller's shop items.
In the case of a Buy It Now purchase, a valid purchase agreement at the Buy It Now price (fixed price) is concluded between the buyer and the seller when the buyer clicks the "Buy It Now" or "Buy It Now & New" button and subsequently confirms it. For fixed-price items for which the seller has selected the "immediate payment" option, the buyer accepts the offer by clicking the "Buy It Now" button and completing the immediately following payment process. The buyer can also accept offers for multiple items by adding the items to the cart (if available) and completing the immediately following payment process. The buyer can also purchase offers with the "Buy It Now" option as a guest without having to log in to eBay. In this case, the buyer accepts the offer by clicking the "Buy It Now" button, selecting the "Continue as Guest" option on the following login page, and completing the immediately following payment process.
In an auction, a valid purchase agreement is concluded with the buyer who has placed the highest bid within the offer period. The purchase price is determined by this highest bid. A bid expires if another buyer places a higher bid during the offer period.
If an auction listing is additionally provided with the Buy It Now option, a valid purchase agreement for the acquisition of the item is concluded at the Buy It Now price (fixed price) regardless of the expiration of the offer period and without conducting an auction as soon as a buyer exercises this option. The option can be exercised by the buyer as long as no bid has yet been placed on the item or the minimum price, if set by the seller, has not yet been reached.
If the seller provides their offer with a Best Offer function, the buyer and seller can negotiate the price for this item. The buyer's submission of the price offer constitutes the binding offer, and the seller's agreement to the price offer constitutes the seller's binding acceptance.
After the conclusion of the contract, the seller sends the buyer a confirmation and information on the purchase processing.
The contract language is exclusively German. The contract text is not saved by the seller and cannot be retrieved after completing an order process (e.g., "Buy It Now"). However, the buyer can save or print the order data immediately before submitting it using their browser's functions.
§ 4 Right of Withdrawal
If the buyer is a consumer, they are entitled by law to a 14-day right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly neither be attributed to their commercial activity nor their self-employed professional activity.
Information on the right of withdrawal can be found in the respective item description provided by the seller. In addition, after the conclusion of the contract, the buyer receives an order confirmation with an instruction on their right of withdrawal and information on how they can exercise it, e.g., via the sample withdrawal form attached to the withdrawal policy.
§ 5 Warranty, Liability
The seller's warranty in the event of a defect in the goods, as well as the seller's liability for damages, is governed by statutory provisions.
§ 6 Final Provisions
These General Terms and Conditions and the respective purchase agreement concluded are governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods. In the event that the buyer is a consumer, this applies only to the extent that the protection afforded by the mandatory provisions of the law of the state in which the consumer has their habitual residence is not deprived.
If one or more clauses of these General Terms and Conditions are invalid in whole or in part, the validity of the remaining provisions shall not be affected thereby.
§ 7 Information on Alternative Dispute Resolution
The European Commission provides an online dispute resolution platform ("OS platform"), which can be accessed via the link http://ec.europa.eu/odr. If the customer is a consumer residing in the European Union, there is the option to use this platform for the out-of-court settlement of disputes over contractual obligations from online purchase agreements.
The seller is not obliged to participate in a dispute resolution procedure before a consumer arbitration board and is generally not willing to do so.
